THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Our duties
We are required by law to keep the privacy of your protected health information ("health information") and to give you this Notice of our legal duties and privacy practices. We must follow the terms of the Notice currently in effect. We must notify you if a breach of your unsecured health information occurs. We may change this Notice, and any change will apply to all health information we hold. If we change it, we'll post the new Notice on our website at https://axiomperformancemedicine.com/notice-of-privacy-practices/ and give you a copy on request.
How we may use and disclose your health information
For treatment. We use and share your health information to provide your care. For example, we may send a prescription to a pharmacy, order labs from a laboratory, or coordinate with another clinician treating you.
For payment. We use and share health information to bill and collect payment for our services. We are a cash-pay practice. We don't bill insurance. Your invoice lists itemized services.
For health care operations. We use and share health information to run the practice, for example quality review, training, licensing and accreditation, legal and compliance work, and business planning.
Business associates. We use service providers to help run the practice, such as our electronic health record, scheduling and patient portal (Practice Better, including its built-in telehealth video), email and our business phone and voicemail (Google Workspace, including Google Voice), our lab-ordering platform (Fullscript), and IT providers. If you agree to texts, Practice Better sends them for us. They may receive health information only under a written agreement that requires them to protect it.
Appointment reminders and health-related services. We may contact you by email, phone or the patient portal about appointments, follow-ups, lab results, and treatment options or services we offer. With your permission, we may also text you through Practice Better for reminders and scheduling, or to tell you a message is waiting in the portal. Texts don't include detailed health information. Message and data rates may apply. Reply STOP to opt out at any time; it won't affect your care.
Other uses and disclosures we may make without your authorization, as allowed or required by law: - As required by law, including to the U.S. Department of Health and Human Services to show HIPAA compliance. - Public health activities, such as reporting certain diseases, adverse drug events to the FDA, or preventing serious threats to health or safety. - Abuse, neglect or domestic violence, to the appropriate government authority, as required or allowed by law. - Health oversight, for audits, investigations, inspections and licensing (for example, the Washington State Board of Nursing or the Department of Health). - Lawsuits and legal proceedings, in response to a court or administrative order, or a subpoena under certain conditions. - Law enforcement, for limited purposes allowed by law. - Coroners, medical examiners and funeral directors. - Organ and tissue donation. - Research, under limited conditions with privacy protections. - Serious threat to health or safety, to prevent or lessen a serious and imminent threat. - Specialized government functions, such as military, national security or protective services. - Workers' compensation, as allowed by law. - Prescription monitoring: Washington law may require us or the pharmacy to report or check controlled-substance prescriptions (for example, testosterone) in the state Prescription Monitoring Program.
People involved in your care. Unless you object, we may share relevant information with a family member, friend or other person you name who is involved in your care or payment for it, or in an emergency.
Uses and disclosures that require your written authorization
We will not do the following without your written authorization: - Use or share psychotherapy notes (we don't expect to keep these). - Use or share health information for marketing. - Sell your health information. - Use your health information, photos or story in testimonials or advertising. - Any other use or disclosure not described in this Notice.
You may revoke an authorization in writing at any time. The revocation won't affect anything we already did in reliance on it.
Washington-specific protections
Washington's Uniform Health Care Information Act (chapter 70.02 RCW) also protects your health information. Washington law gives extra protection to certain sensitive information, such as sexually transmitted infection and HIV information, mental health information, and reproductive and sexual health information. We disclose it only as Washington law allows. Consumer health data that HIPAA doesn't cover is described in our Consumer Health Data Privacy Policy. Where state law is more protective than HIPAA, we follow state law.
Your rights
- Get a copy of your health information. You can ask to see or get an electronic or paper copy of your medical record. We'll respond within 15 working days, as Washington law requires (RCW 70.02.080). We may charge a reasonable, cost-based fee.
- Ask us to correct your record. You can ask us to correct health information you think is wrong or incomplete. We may say no, but we'll tell you why in writing.

- Ask us to limit what we use or share. You can ask us not to use or share certain information for treatment, payment or operations. We aren't required to agree, except that if you pay out of pocket in full for a service, you can ask us not to share that information with your health plan, and we will agree unless the law requires us to share it.
- Get a list of disclosures. You can ask for a list (accounting) of the times we shared your health information in the six years before your request, who we shared it with, and why. Disclosures for treatment, payment, operations, and certain others are excluded. One list a year is free.
